Hasnor Afifah binti Mohd Noor & Lontex Group Sp. z.o.o. v XFYRE (M) Sdn Bhd & Ors

The Plaintiffs, Hasnor Afifah binti Mohd Noor (trading as Simfoni Humaira Resources) and Lontex Group Sp. z.o.o., sought a declaration that a Sale and Purchase Agreement (SPA) dated 15.9.2020 was mutually terminated due to the 1st Defendant's failure to deliver goods. The Plaintiffs also sought a refund of RM1,194,000.00 held under a Stakeholder Agreement. The High Court dismissed the 1st Defendant's application for a stay of proceedings and security for costs, and also dismissed an application to remove the 2nd to 7th Defendants from the case.
