Brenda Wong v Yap Hee Tai

The appellant, Brenda Wong, appealed against the Sessions Court's decision to dismiss her claim for the recovery of a USD150,000 commission payment made to the respondent, Yap Hee Tai, for a loan that failed to materialize. The High Court allowed the appeal, finding that the respondent was liable to return the payment under Section 71 of the Contracts Act 1950, as the respondent failed to prove the money was no longer in her account.
